How long does it take to get probate in Ontario?

Timeline varies significantly by the specific court jurisdiction in Ontario. Some courts process applications in a matter of weeks, while busier regions can take several months.

What are the primary responsibilities of an Estate Trustee?

An Estate Trustee is responsible for locating the will, inventorying assets, paying outstanding debts and taxes, and distributing the remaining estate to the beneficiaries according to the law.

What are the fees for a professional Estate Trustee in Ontario?

In Ontario, an Estate Trustee’s compensation is typically guided by the Tariff, which suggests about 5% of the total estate value (calculated on capital, revenue, and care/management). However, this is a guideline, not a rule. Our fees are transparent and based on the complexity and time required for the specific estate. What’s the difference between an Estate Trustee and an Executor?

You are not obligated to accept the role. You can formally “renounce” your position as Estate Trustee, provided you have not yet started to perform any of the duties (a concept called “intermeddling”). It’s a formal legal process, and once you renounce, the alternate trustee named in the Will can step in, or beneficiaries can agree to appoint a professional like us.
